"Aberdeen Estates at Benson Woods" and the constructed "Benson Woods" located across the way are two independent communities, each constructed by different builders/developers and each operating under its own homeowners association (HOA) with separate rules and regulations.
Includes snow removal, ice management, landscaping services, and weekly curbside trash and recycle pick-up.
*If the proposed clubhouse is built, the estimated additional fee per unit per month shall be $16.67.
The residences at Aberdeen Estates are insured from the inside walls out, included in your HOA Fee. Owners must only provide content insurance for ownership. The owners need to insure their personal property and any betterment or improvements they do. The HOA policy insures how the units are originally constructed “All-in Coverage.
Two approved household pets (cat or dog) are allowed. Dogs shall not exceed 100 pounds at maturity and shall be of gentle disposition.
The HOA is responsible for the mowing of the entire development, lawn treatments, mulching, and upkeep of plantings and site trees as shown on the development plan.
Aberdeen Estates is a Planned Unit Development (PUD). A homeowner owns their unit, inside walls out, and a portion of land behind their unit. PUDs allow more freedom of use within certain guidelines.
As to units located in Middlebury, the following occupancy rules apply:
1. At least one individual who is age 55 or older shall own and occupy the Unit, except under the circumstances set forth in this Section X of the Declaration.
2. The 55 year-old individual may co-own the Unit with a spouse, and the spouse and one other occupant age 18 or over may reside with them. In no event may a Unit be occupied by persons under the age of eighteen (18).
3. An occupant who has survived an individual owner over the age of 55, and who has an ownership interest in the dwelling may reside there.
4. An occupant over the age of 18, and who has an ownership interest and resides in a Unit vacated by an individual over the age of fifty-five who has entered a long-term continuing care facility may reside there.
5. A person essential to the care and well-being of a disabled or handicapped resident owner may occupy his or her dwelling unit.
6. The purchase of a dwelling unit for investment purposes by an entity or an individual not intending to occupy the dwelling is prohibited, except that a nonresident family member may purchase up to one unit for a family member who will reside in the dwelling unit and otherwise comply with the requirements of the Bylaws and the Rules of the Association.
7. The Association may, upon written request of any proposed resident aged 54 or older who will not have attained the age of 55 as of his or her proposed date of occupancy, permit such proposed resident to occupy a Unit on a provisional basis until such person becomes an Eligible Resident but for a period not in excess of 11 months, upon the showing of family or financial hardship.
8. Notwithstanding subparagraphs 1-7 above, it is the express requirement of the Declaration that the Common Interest Community qualify as "housing for older persons" under the Fair Housing Act, as amended, and unless waived by the unanimous vote of the Board of Directors, any comparable designation under any similar state or federal law which permits the Common Interest Community to maintain its age, use and occupancy restrictions and the zoning and land use requirements of the Town of Middlebury. The rules ser forth herein shall be administered, interpreted and enforced so as to meet such statutory and regulatory requirements, including, as necessary, the provision of absolute percentage limitations on the number of Units which are occupied solely by noneligible Residents and Eligible Spouses and, if necessary the termination of the occupancy rights of any Unit or Units by non-eligible residents otherwise permitted under Subparagraphs 1-7.
9. The foregoing occupancy restrictions shall not be construed to prevent the occupants of any of the Units from entertaining guests of any age in their units, including temporary residency not to exceed six (6) months in any 12-month period.
